Terms & Conditions
The Nappy Taxi services are provided subject to your (hereinafter "Customer") compliance and acceptance with the terms and conditions set forth below. As a condition to using any of The Nappy Taxi services, and for the mutual benefit of both The Nappy Taxi and the Customer, the undersigned ("Customer") agrees to the following terms and conditions
SERVICES AND INCLUSIONSThe Nappy Taxi will provide customers who have selected the modern cloth service with a leased Starter Kit (hereinafter referred to as “Kit”) for a fee of $299. upon completion of signup process via signing this agreement or via our website www.thenappytaxi .com.au and confirmation of entering into this agreement with The Nappy Taxi . Confirmation should be made by selecting the Tick Box “Agree to Terms and Conditions” on the website sign up form or by signing below. Customers who have selected the BYO cloth service will be provided with 2 Nappy Cubes for a fee of $30.00.The leased Starter Kit includes but is not limited to:-50 Modern Cloth Nappies 2 Nappy Cubes1 Wet Bag 100 Flush-able Bamboo Liners 1 Shaker of The Nappy Taxi Dry Soak Solution A Certificate from our Plant-a-Tree Program** Unlimited Access to Tabatinga Coffs Harbour * * Each Customer of The Nappy Taxi is entitled to a gold membership with Tabatinga Coffs Harbour which is subject to Terms and Conditions of Tabatinga Coffs Harbour. The customers membership is only valid while they are current customers of The Nappy Taxi.** Each Customer of The Nappy Taxi who completes a full 6 month contract shall have a tree purchased on their behalf with Carbon Neutral Australia. The purchase of these trees occurs at the end of each calendar year in accordance with the planting schedule of Carbon Neutral.
SECURITY OF PICK UP / DELIVERY LOCATIONSThe Nappy Taxi will provide pick up & delivery services for all The Nappy Taxi customers on a twice weekly basis. The exact pickup and delivery location at Customer’s home, office or day care center must be provided by the Customer and MUST be guaranteed by the Customer to be secure. As the customer is leasing our nappies and Starter Kit, the customer is liable for any loss incurred via theft or damage of The Nappy Taxi nappies and this cost will be charged to the Customer.Soiled nappies are to be left in a secure location (such as on the front porch / doorstep or by the mailbox) for collection that evening. Nappies should be left out no later than 5am on collection / Delivery Days. Clean nappies will be left in their place once the soiled nappies have been collected. Delivery will be up to 25 clean nappies with matching inserts and night time boosters (depending on the amount previously picked up from the Customer). This delivery will occur twice a week on the designated Delivery Days for your area, and these will be known as the “Scheduled Delivery Days” during the Term of this Agreement.
PAYMENT FOR SERVICES Customers are required to book an initial period of no less than 12 weeks with The Nappy Taxi. Customers whom have chosen to sign or renew their contract with The Nappy Taxi will be required to provide credit card and / or bank account information for debiting on a weekly basis or monthly, in advance, for the services provided by The Nappy Taxi.The Nappy Taxi is under no obligation to provide any services to a Customer not fully paid for by the Customer in advance. DELIVERY ON PUBLIC HOLIDAYSThe Nappy Taxi reserves the right not to offer delivery services on Public Holidays, including Christmas Day, Boxing Day, Easter Monday, New Year’s Day, Australia day etc. Customers will be notified in writing via email or text if the scheduled delivery day is to be postponed due to a Public Holiday. The delivery service will then be performed either on the next available business day or the business day prior to the Public Holiday.Changes to the Delivery Schedule will be communicated at least 7 days in advance to The Nappy Taxi customers.
PICK UP DAYS AND TIMES Customers must place all used nappies in The Nappy Cube provided before the relevant Scheduled Delivery Day. The Nappy Cube full of soiled nappies should be left outside the home of the Customer, available for pickup, on Scheduled Delivery Day. It is recommended that Customers leave the bag out for pickup no later than 5am on the Scheduled Delivery Day. All Delivery Runs are conducted in the early hour of the morning, commencing at 5am. It is therefore not possible to deliver personally to clients and a secure location is required for nappies to be collected and delivered. The nominated secure location must be chosen by the Customer and is required to be monitored to ensure that all items are secure. Any missing items resulting from theft must be replaced at the Customer’s expense. Delivery will be up to 25 clean nappies with matching inserts night time boosters (depending on the amount previously picked up from the Customer). This delivery will occur twice weekly.It is the Customer's responsibility to have The Nappy Taxi cube ready at agreed upon day and location. The Nappy Taxi reserves the right to determine the pick-up and drop-off TIMES at its own discretion and reserves the right to reschedule such times without prior notice to Customer. Please note that scheduled Delivery DAYS will NOT be rescheduled without prior notice to the Customer. In the case of the Nappy Cube not being left out, the customer will be contacted later that day and offered another pick up but only if possible and at a fee of $10.00.Should a Customer not have the bucket available for pick up on Scheduled Delivery Day, the Customer will be charged for the full amount of the weekly service as normal and pick up will resume on the next Scheduled Delivery Day.
NOTICE OF RESTRICTIONS The following list, which constitutes the Notice of Restrictions, shall apply to all Customers of The Nappy Taxi, without exception. i. The Nappy Taxi will use reasonable efforts to try to ensure that its cleaning service is of the highest hygienic standards possible without the use of harsh chemicals or bleaches.ii. All the Nappy Taxi nappies will be washed in pH neutral product with no acids strong alkali or non-biodegradable surfactants. We operate an environmentally friendly business and aim to sanitize our nappy in the most environmental way were possible.iii. The Nappy Taxi will NOT be held responsible for any rashes or marks that occur on children using The Nappy Taxi modern cloth nappies. Whilst we take all possible measures to ensure our nappies are washed specifically for sensitive skin we take no responsibility for any skin reactions that may occur as a result of using The Nappy Taxi modern cloth nappies.iv. The Nappy Taxi will regularly inspect your set of nappies for any sign of overuse, wear, tear or damage and will replace any articles that show normal signs of wear. Any article believed to be damaged through misuse or recklessness will charged to the Customer.v. The Nappy Taxi is not responsible for loss of or damage to any personal or non-cleanable items left in The Nappy Taxi buckets such as money, jewelry, or anything else. Customer agrees not to leave such items in the delivery bucket. vi. The Nappy Taxi is not responsible for any loss, damage or theft of items left unattended for pick up-or drop-off by Customer. Customer MUST provide a secure location for pick up and drop off of nappies and assume all responsibility for the cost of nappies that are unaccounted for due to theft or misplacement.vii. The Nappy Taxi will provide a roll of flushable bamboo liners complimentary in the Kit. You will receive a new roll every 2 weeks. The Nappy Taxi will also supply dry soak solution refills every 2 weeks also.viii. The Nappy Taxi reserves the right to charge the Customer for extra cleaning services required if the nappies are returned containing “solid” matter. It is a condition of the service agreement that the Customer will remove solid matter from the nappies before leaving them out for collection. Customers who return nappies full of solid matter will be charged a loading of 50% of the weekly service fee. ix. The Nappy Taxi reserves the right to refuse cleaning any set of nappies and will charge the Customer for the cost of nappies deemed to be unsanitary after three previous written warnings regarding the non-removal of solid matter. x. The Nappy Taxi does not guarantee the removal of all stains, although every effort will be made to do so.
COOLING OFF PERIOD The Customer is entitled to a 5 day Cooling Off Period with regard to their contract with The Nappy Taxi. The 5 day cooling Off Period commences on the designated Start Date and ends on the 5th business day thereafter. After this time, the Customer is considered to be in contract with The Nappy Taxi. Termination of the Agreement within the Cooling Off Period must be communicated to The Nappy Taxi in writing before the 5th business day after the Customer Start Date. Phone calls, phone messages or SMS are not in accordance with these Terms and Conditions and will not be actioned for termination of services. If the Customer terminates the Agreement within the Cooling Off Period, The Nappy Taxi will issue a full refund of the Service Fee less day(s) of service used, but will not refund the starter kit cost. The customer is therefore entitled to keep the contents of the starter kit. TERMINATION OF CONTRACTIn the event that there are any unpaid Service Fees due and Customer does not pay upon demand by The Nappy Taxi , The Nappy Taxi may terminate this Agreement and may initiate legal proceedings against Customer for the full amount due for the entire Term and collect reasonable attorney's fees and costs. Interest will accrue on any unpaid balance at 10.5% per month. All cloth nappies acquired through The Nappy Taxi remain the sole property of The Nappy Taxi but if a Customer wishes to suspend or terminate their or their service contract ends with The Nappy Taxi, all materials from the leased Starter Kit will then become the property of the customer upon the full payment of the agreed contract. 3 months agreements do not allow customers to own their started kit contents only customers who choose a 6 or 12 months service will own the contents after their service is completed and paid in full. Should a Customer be under contract with The Nappy Taxi the Customer may be liable for the full amount remaining on the contract with The Nappy Taxi if they terminate the contract prior to the contract termination date.
SERVICE SUSPENSION Customers must provide The Nappy Taxi written notice of at least 48 hours prior to suspension of their service. Requests for suspension will be actioned and the client issued with a Service Period Credit. Details of the new Renewal Date for the client will be communicated in writing once a Service Period Credit has been issued. Requests for suspension outside of these terms may be actioned however the client will forfeit their service for that period.WASHING VENDORSThe Nappy Taxi or its associates will deliver modern cloth nappies to and from a wash / dry / fold service of The Nappy Taxi’s choice. The Nappy Taxi reserves the right to utilize any outsourcer, vendor, or outside service provider, for any service, at its sole discretion without notice to Customer. Customer may not transfer this agreement.
THE NAPPY TAXI LIABILITY The Nappy Taxi ’s liability under this agreement shall be limited to general money damages in an amount not to exceed the charges for the term of service paid by Customer in the term under which the damages are alleged to have occurred. The preceding statement of liability shall be the extent of The Nappy Taxi ’s liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute Customer's exclusive remedy. In no event will The Nappy Taxi be held liable or be responsible for any consequential, special, indirect, incidental, or punitive loss or damages whether or not The Nappy Taxi knew or should have known of the likelihood of any loss or damages. The Nappy Taxi disclaims all warranties express or implied with respect to the services rendered under this agreement.This agreement and any documents referred to herein constitute the complete, exclusive, and entire agreement between the parties, may not be modified except in writing signed by both parties; and shall be governed by Australian Federal law, with venue and jurisdiction proper in the place where services were provided.
PROPER MCN USE Our rental diapers are to be used on babies only. Nappies found being used as cleaning rags or for other non-baby related uses will need to be removed from service due to the inability to remove chemicals or stains. If a MC Nappy needs to be removed from service, you will be charged the replacement fee. Certain medications or nappy creams can cause untreatable stains that ruin rented nappy. Please notify us if your child’s doctor has prescribed any medications or nappy rash creams. Please minimize the use of nappy creams containing Zinc Oxide without a reusable or disposable diaper liner as these can damage the nappies. Do not store soiled nappies in the heat (example: outside or in a garage during the summer) or in direct sunlight. This will cause unpleasant things to grow and may damage the nappies.There is no need to rinse soiled nappies. In fact, this can cause mold or mildew. Please shake off soiled nappies when possible and place in bucket.Please do not store nappies in sealed plastic. This also causes mold and mildew. Wet bags have been provided and are available for sale on our website. If you damage a nappy, you will be billed for it.
VACTION AND MOVING Please contact us at least 1 week prior to your move with the new address and the delivery date in which service would like to be switched to the new address. If you are going on a holiday, please contact us 1 week prior to your departure to let us know the dates. Depending on what days your holiday is relative to your delivery day, we will still schedule a pickup/delivery and/or skip pickup/delivery, which is dependent on minimizing time soiled nappies will be left sitting. If you are going on vacation for longer than 1 week, please contact us 1 week prior to your departure and let us know the dates as we may have to pick up ALL your diapers (clean and soiled) and hold delivery until the date specified.
